Terms of Use

1. Acceptance of terms

By creating an account and using the Brivoo platform, you agree to these Terms of Use and our Privacy Policy. If you do not agree, do not use the service.

Material changes will be communicated by email 30 days in advance. Continued use after that date constitutes acceptance of the updated terms.

2. Description of the service

Brivoo is a SaaS platform developed and operated by Carniatto Labs Ltda. (a Brazilian company), designed to help freelancers and small businesses create, customise and share professional quotes.

The platform offers free and paid plans, with limits and features described on the pricing page.

3. Account and responsibilities

• ◆You are responsible for the confidentiality of your credentials and all activities carried out on your account
• ◆Information provided during registration must be truthful and kept up to date
• ◆One account per person or company — multiple accounts to bypass free plan limits will result in closure of all accounts
• ◆Users under 18 require parental or guardian consent

4. Plans, payments and right of withdrawal

Free plan: up to 3 quotes per month, no custom logo, history limited to 10 quotes.

Paid plan:

• ◆Monthly or annual billing via credit card processed by Stripe, Inc.
• ◆The amount is charged at the start of each billing period
• ◆Prices may change with 30 days' notice by email

Right of withdrawal (Directive 2011/83/EU):

• ◆You have 14 calendar days from the date of purchase to withdraw without penalty
• ◆After that period, no proportional refunds are made for unused time
• ◆If the service is unavailable due to our fault for more than 72 consecutive hours, the period will be credited proportionally to the next billing cycle

5. Content and intellectual property

• ◆Content you create on the platform (quotes, texts, images) remains your property
• ◆You grant Carniatto Labs Ltda. a limited, non-exclusive, revocable licence to store and display that content solely to provide the service
• ◆The Brivoo brand, source code and platform interfaces are the exclusive property of Carniatto Labs Ltda.
• ◆Upon account closure, the licence granted is revoked

6. Prohibited use

You may not use Brivoo to:

• ◆Send spam, misleading or fraudulent content
• ◆Infringe third-party intellectual property or privacy rights
• ◆Attempt to compromise the security, integrity or availability of the system
• ◆Resell, sublicence or redistribute the service without express authorisation
• ◆Reverse-engineer the source code
• ◆Any purpose unlawful under applicable law

Violations may result in immediate account closure, without prejudice to legal action.

7. Availability and limitation of liability

The service is provided "as-is", with reasonable availability efforts, without guarantee of uninterrupted operation.

Carniatto Labs Ltda. is not liable for:

• ◆Indirect losses, lost profits or consequential damages
• ◆Unavailability caused by force majeure, third-party infrastructure failures or cyberattacks
• ◆Content created by users on the platform

Maximum liability: the amount paid in the last 3 months of subscription or €100, whichever is greater. This limitation does not affect non-waivable rights under EU consumer law.

8. Cancellation and account closure

By the user: at any time from profile settings — no cancellation fees.

By Carniatto Labs Ltda.: accounts that breach these terms may be suspended or closed, with or without prior notice depending on the severity of the breach.

After closure:

• ◆Your data is deleted immediately

9. Force majeure

Carniatto Labs Ltda. shall not be liable for delays or failures caused by events beyond its reasonable control, including natural disasters, third-party infrastructure failures, power outages, DDoS attacks or government orders.

10. Applicable law and jurisdiction

These terms are governed by the law of the user's country of residence within the EU/EEA. Disputes shall be submitted to the competent courts of the user's place of habitual residence, in accordance with GDPR Art. 79 and EU Regulation 1215/2012 (Brussels I Recast).
